Agreement
By creating an account or using The Marksmith AU, you agree to these terms and to our Privacy Policy, including our keeping and using your information as that policy describes. If you are under 18, a parent or guardian must also agree, including to any payment.
The service and what it costs
We provide original practice questions for the NSW HSC and a study plan built from your mistakes. Mark, our HSC-calibrated AI, marks your written answers, without your name or email.
Each marked answer is paid from your prepaid balance, at the price shown before you hand in. For work you bring to Review your own work, you see an estimate before you send it and are charged the exact amount when it is marked. Multiple choice and “Check it yourself” practice never use your balance.
Your first 3 marked questions are on us, as a sample of the service: once per person, whatever device you use, after you confirm your email. We may choose which questions the sample covers, and it does not cover an essay or a paper.
No pass is needed at present. If one becomes required, its price and terms will be shown before you buy.
Your balance
Your balance is in Australian dollars and covers all your subjects. You top it up by card ($10, $20, $30, $50 or $100) on Square's secure payment page, and it is added once the payment goes through. It never goes below zero, nothing renews automatically, and it does not expire.
Your account
One person, one account. Keep your sign-in to yourself. You must not:
- Create more than one account, share yours or use someone else's, including to receive more sample questions.
- Hand in work that is not your own.
- Copy, share or sell our questions, marking or plans, use bots or scripts on the app, or try to break or overload it.
Your work and ours
Your answers remain yours. You give us a non-exclusive licence to store and use them to mark your work, build your plan, make your later marking more precise and run the app, including through the services we use. Photos are deleted within 7 days; we keep the typed text of your answer. Our questions, marking, plans and the app belong to us; you may use them only for your own study.
Quotes you type into your writing kit may be shown to other students as samples, without your name.
Independent, no guaranteed results
The Marksmith AU is independent and is not affiliated with, or endorsed by, NESA. Our questions are our own, and our marks are not official HSC marks. They are a guide for practice, not a prediction, and we do not guarantee any mark, band or result.
Your rights under the law
The app may sometimes be unavailable, and we may change parts of it.
Nothing in these terms limits your rights under the Australian Consumer Law. Beyond those rights, and as far as the law allows, we are not liable for indirect or consequential loss.
Closing and changes
We may suspend or close an account that breaks these terms. If we close your account or stop the service, unused balance is refunded.
We may update these terms. We will post each version here with its date and email you before an important change. A change never affects a price you saw before handing in, or balance you have already paid for. If you don't accept a change, we will refund your balance; continuing to use the app means you accept it.
